The tree in question continues to cause damage to neighbouring properties, but permission to remove it was refused, with the expert report stating that if routine tree management were undertaken it would not cause problems. I am therefore applying for permission to undertake a lift of the canopy over the property as suggested by the expert report, which it describes as a reasonable and proportionate management response. Description of Proposed Works 1 - Removal of one lower secondary limb overhanging the neighbouring garden at approximately 5 m above ground level. The limb will be removed back to the main stem at a suitable growth point, retaining the branch collar. This is intended to reduce needle fall, prevent damage to garden plants, and improve light levels. All works will be carried out in accordance with BS39982010. 2 - Reduction of one lateral limb extending over the neighbours roof. Reduction will be made to an appropriate secondary branch to maintain natural form and balance. This is intended to reduce gutter blockage, lessen debris accumulation, and improve daylight to the front rooms of the neighbouring property. All cuts will comply with BS39982010. 3 - General Safety and Amenity. Crown lift to 3.5 metres above ground level over the neighbouring property by removing selected lower secondary branches only. No primary scaffold limbs will be removed. No more than 10 to 15 percent of the live crown volume to be removed. The overall form, height, and amenity value of the tree will be retained. All works will be undertaken by a suitably qualified arborist and will comply with BS39982010.

We would propose to only remove all dead, lower branches for the safety of the public (branches dying and falling) and to help the upper limbs thrive better Pictures 6 and 7 - Show T 19 - Fir Tree with lots of dead lower level branches which is allowing ivy and other creepers to grow up the tree, leading to potential wider spread damage. I would like to remove the Magnolia Tree. It has become too large for the space and the root system has caused damage to the surrounding wall and driveway over the years which has been repaired but its now lifting the wall again from the foundations and its time to remove it and re-plant a smaller version. From the photos you can see the repairs to the driveway as the roots were causing cracking and also the repairs to retaining wall. It continues to grow vigorously year on year and its just got too big for what is a small space and I can't keep on top of the continual repairs needed.

Mixed Species Size Boundary Hedge between number 16 and number 14; remove all hedges to 1 ft above ground level in order for a mechanical device to pull out stumps. Front boundary yew hedge running parallel with the road; remove the front row only closest to the property to ground level. Remaining hedge to be reduced in height by 50% and all remaining profiles to be trimmed. Conservation Area Justification The proposed works are to facilitate the removal and replacement of an existing deteriorating boundary hedge and associated vegetation in order to install a new, more suitable and manageable boundary treatment. The existing mixed species hedge located between Nos. 14 and 16 has become overgrown, uneven in form, and is no longer considered appropriate for its intended boundary function. Removal to approximately 300 mm (1 foot) above ground level is required to allow the safe use of mechanical equipment for stump extraction and preparation of the area for the proposed replacement boundary installation. Works to the front boundary Yew hedge are proposed to retain the majority of the existing screening and visual amenity value whilst allowing sufficient space for the new boundary arrangement. Only the front row of Yew growth nearest the property is to be removed to ground level, with the retained hedge reduced in height by approximately 50% and trimmed on all remaining profiles to restore a manageable, uniform, and sustainable form. The proposed works are considered reasonable arboricultural management and are not expected to have a significant adverse impact on the character or appearance of the Conservation Area. The retained hedge sections will continue to provide screening, soft landscaping, and ecological value, whilst the replacement boundary treatment will improve the long-term usability, maintenance, and presentation of the site. All arisings will be removed from site and returned to a Devon Tree Services Ltd depot for recycling, leaving the area safe, clean
