Discharge of Conditions 2, 5 and 6 of previously approved application LA06/2018/0541/F - Discharge of Condition 2 which states - The vehicular access, including visibility splays and any forward sight distance, shall be provided in accordance with Drawing No.05C bearing the date stamp 6th October 2020, prior to the commencement of any other development hereby permitted. The area within the visibility splays and any forward sight line shall be cleared to provide a level surface no higher than 250mm above the level of the adjoining carriageway and such splays shall be retained and kept clear thereafter. Reason: To ensure there is a satisfactory means of access in the interests of road safety and the convenience of road users. Discharge of Condition 5 which states:- No development shall take place on-site until either the Waste Water Treatment Works at Ballygowan has been upgraded and becomes fully operational, in line with planning permission LA06/2018/1213/F, and it has been agreed with NI Water in writing that there is available capacity to serve the approved apartments or alternatively, a Consent to discharge for the private treatment plant has been granted in writing under the terms of the Water (NI) Order 1999. Reason: To ensure protection of the aquatic environment and to help the applicant avoid incurring unnecessary expense before it can be ascertained that a feasible method of sewage disposal is possible at this site. Discharge of Condition 6 which states:- Prior to any works commencing on site, a final Construction Environmental Management Plan and finalised Site Drainage Plan shall be submitted by the applicant/approved contractor to the Council for agreement in writing. This shall reflect and detail all the pollution prevention, mitigation and avoidance measures as outlined within the Outline Construction Environmental Management Plan (date stamped 24th May 2019) and all additional submitted information. All measures agreed in the final Construction Environmental Management Plan and finalised Site Drainage Plan shall be implemented as approved. Reason: To ensure that the appointed contractor is aware of and implements the appropriate environmental mitigation during construction phase that will protect the hydrologically connected European Site features.
