What a grant of permission means

The process from here

Permission has been granted, usually subject to conditions listed on the decision notice, some of which must be discharged before work starts. The decision notice on the council portal sets out exactly what was approved.

Work must normally begin within three years of the decision or the permission lapses. Neighbours cannot appeal a grant; challenging one means judicial review of how the decision was made, within tight time limits.

About householder applications

How this application type works

Householder applications cover work to an existing house and its garden: extensions, loft and garage conversions, porches, outbuildings and similar alterations within the boundary of the home. They cannot be used to create a separate dwelling or change what the building is used for. Councils aim to decide them within eight weeks, and immediate neighbours are usually notified and given a chance to comment.

Removal of non-native maple tree on rear boundary to neighbouring property (2 Hawthorn Road). It does not have a preservation order. It sits very close to the boundary wall and we have had complaints from neighbours about loss of light and they have had drainage issues caused by tree roots (effluent backing up into their property). It has also brought down communication lines and threatens to do more. HAR/CA21.

In 2020 we applies dor 3 large Conifers at rear of property, close to back of the house. We cut down 2 and now wish to fell the third (T1). This is close to house, taller than house and restricts light into neighbours and our house. It has caused problems in neighbours drains and restricts growth of a Silver Birch. T2, Conifer is rear of garden and restricts any other plant growth. HAR/CA14.

Rear garden is 29m x 15m with many trees (see diagram). We wish to cut down the Leylandii which is growing up and through the Ash tree. In addition we wish to have a tree surgeon reduce the crown of the Ash by no more than 30%. The Leylandii is referenced tree 1 and the Ash tree 2. The Ash we believe was taken back via a similar crown reduction many years ago, but has grown a lot in this time. In addition the Leylandii has grown much more and as it is less than 2m away is completely overpowering the Ash tree, it is also now taller than the Ash. HAR/CA14

Conifer (photo 1 and photo 2) fell because too large and little grows below it in our garden or the next door neighbours garden. They also wish it to be removed. The soil in which the tree is planted is totally dry and exhausted. Replant with one oak tree in the same position and add a hazel hedge at the bottom of the garden. HAR/CA14
