The occupation and use of the dwelling separately from, and otherwise than in connection with and ancillary to, the occupation and use of 56A North Street as a single dwellinghouse, constitutes a failure to comply with Condition 3 of planning permission P00/N0787 granted on 29 January 2001. A certificate is sought under section 191(1)(c) of the Act that that failure to comply is lawful, the time for taking enforcement action having expired. Each of the above relates to the land and buildings edged red on the submitted location and block plans, the whole of which is in the ownership of the Applicant.
