The application relates to the dwellinghouse and all land edged red on the submitted location plan, which together form a single residential planning unit. Part of the land edged red was historically part of a field (formerly used as grazing/horse paddock land) and was conveyed into the ownership of the dwelling in 1979. Since 1979, that land has been physically enclosed and used continuously as domestic garden land incidental to the enjoyment of the dwellinghouse. It has functioned as part of the residential curtilage and has not been used for agricultural, equestrian or other non-residential purposes during this period. The use of the land as residential curtilage has therefore continued for a period substantially in excess of 10 years and is lawful through the passage of time under Section 171B of the Town and Country Planning Act 1990.
