What refusal means

The process from here

The council refused this application for the reasons set out on the decision notice, which the council portal holds in full. Only the applicant can appeal a refusal; the time limit runs from the decision date and is shorter for householder schemes.

Refusal does not prevent a fresh attempt. Applicants often address the reasons for refusal and resubmit, so a refused scheme is not necessarily the end of proposals for the site.

About lawful development applications

How this application type works

A lawful development certificate is a legal determination, not a planning judgement. It asks the council to confirm either that existing use or works are lawful, often through the passage of time, or that a proposal would not need planning permission at all. The applicant must prove the facts; the merits of the scheme are not considered.

Palm tree. Removal. Small palm tree in front of the property window. Roughly 2.3m high. Roughly 2m from property We propose removing this palm tree as it is getting bigger and is now beginning to block light into the property. Additionally we want to create a seating area to the front of the property. Additional context. We are removing more shrubbery to the front and within the garden at a lower height than 1.5 metres. This is predominantly about 'levelling' the current garden as it is on multiple levels and is dangerous. We propose adding in rose bushes, bramble bushes and another apple tree in another part of the garden as part of the changes. The removal of anything is mainly shrubs, ferns, fig bush and grasses at a low level. The palm tree is the only tree over 1.5 metres with a diameter of over 7.5cm in the garden that we are proposing changing. We would not want to add a replacement tree in the same part of the garden as it would create the same issue of light blocking. We would propose adding trees and bushes into other parts of the garden (listed above) that don't block light or views for neighbouring properties.
