Proposal
Removal of Condition 2 for planning application 08/AP/1476 dated 21/10/2009 for Change of use of the existing B2 Business Use/Light Industrial, 3-storey premises, to a mixed use B1 - Business, D1- Non-residential institution, D2 - Assembly building for Small to Medium Enterprise (SME) business start-up building, by retaining part of the building as offices for SME business start-up units; and establishing a performing arts centre incorporating dance studios, recording studios, recital hall and auditorium with back stage facilities, training and resource rooms; and use as a place of worship. Removal Condition 2 restricts the approved D1 Non-residential institution and D2 Assembly building uses to "Liberty Development Enterprise" as a personal restriction. This condition has become obsolete as Liberty Development Enterprise has vacated the premises and relocated their operations elsewhere. The building is now successfully operated by a church organisation providing the same community facilities originally envisaged - place of worship, community activities, and associated services. Complete removal of Condition 2. No variation is sought - the condition should be deleted in its entirety to remove the personal restriction whilst retaining all other operational conditions that provide appropriate planning control over the community facility's operation.
