What a grant of permission means

The process from here

Permission has been granted, usually subject to conditions listed on the decision notice, some of which must be discharged before work starts. The decision notice on the council portal sets out exactly what was approved.

Work must normally begin within three years of the decision or the permission lapses. Neighbours cannot appeal a grant; challenging one means judicial review of how the decision was made, within tight time limits.

About lawful development applications

How this application type works

A lawful development certificate is a legal determination, not a planning judgement. It asks the council to confirm either that existing use or works are lawful, often through the passage of time, or that a proposal would not need planning permission at all. The applicant must prove the facts; the merits of the scheme are not considered.

MODIFIED SPECIFICATION FOR CROWN THINNING SEE CONDITION 2 T1- Cedar - Remove all major dead wood from the crown of the Cedar tree and inspect the tree for overall health. T2 - Sycamore - Reduce the overextended lateral limbs that are heavily overhanging the neighbours garden and homeowners outbuilding with two branches snapping recently a reduction of 1.5-2m on all overextended lateral limbs blending the reduction into the upper crown and removing all dead wood to create a well shaped and balanced crown. crown lift up to 4m to keep the branches away from the outbuilding roof. Remove all major dead wood. T3 - Cherry - Reduce the overextended lateral limbs and any branches to create a well shaped and balanced crow. Crown thin by approximately 20% to allow more dappled light in to the garden and grass area below. Remove all major dead wood. T4 - Sycamore - Reduce the overextended lateral limbs and crown lift to 4m to create a well shaped and balanced crown. thin the crown by approximately 20% to allow more dappled light into the garden and grass area below. The reason for all the above work is to keep the trees healthy and in good shape with out massively impacting the surrounding properties in a negative way. The neighbour has complained multiple times that there garden is being overtaken by the homeowners trees and although both properties love having the trees in the gardens they are now blocking all the light and killing the grass below and making the bottom of the gardens unusable due lack of light. All work listed above will be compliant with BS3998 and help reshape the trees and help contain them in a limited space with out detrimental effect.

Fell the large Ash tree T1 that is suffering from Ash die back and is situated very close to the property. The owner of the tree has noticed a 50% reduction in crown density over the last 2 years with multiple large limbs dropping with visible cankers and lesions visible from the ground level. The tree is within 8m of the property and leaning heavily toward the property with branches growing toward the property, the home owner is very worried about safety of their family. Two large limbs have snapped and currently resting on other limbs making it unsafe for the children to play in the garden. The property has lots of Oak, Beech and Cherry trees and replanting a young healthy tree would be in the interest of our client. All work will be BS3998 compliant.

Fell the large Ash tree listed at T2 on the map and cut the stump as close to ground level as possible. This Ash tree is situated on the 2nd tier of the garden over multiple outbuildings and should be classed as high risk. With no option of a Cherry picker or crane getting access to the tree it doesn't have long left before it is unsafe to climb and with no other option of removal would be left to become very unsafe and make the whole of the garden completely unusable for the family. The crown has large dead limbs all around and with only around 303 of foliage compared to a healthy Ash tree I believe removing this tree as soon as possible is of most importance. The garden has multiple Oak, Beech and Cherry trees and the replanting of one of these would be of interest of our client. Crown lift the lower branches of the Cedar listed as T3 on the map. The lower crown is growing heavily over the neighbours garden and branches starting to droop. A light reduction on all lower limbs up to 5m of 1m to help reduce the weight and clean the crown of all dead wood. All work will be BS3998 compliant.
