Refused Nottingham 22/00552/PTPO Works to trees protected by TPO

Works: Trees

Refused. Only the applicant can appeal, within the statutory time limit, and a revised scheme can be submitted instead.

Proposal

The two trees are Sycamores, numberd 6 and 8 on the attached diagram. We are looking to fell them for the following reasons: 1) The presence of these trees is affected the quality of life for people living in the neighbouring flats, as the trees not only block most light into their living areas in the summer. The bottom floor flats are approximately 3-4m below ground level of the trees, for example, and this makes living there gloomy for several months of the year. In addition, the amount of honeydew from this particular species of tree makes their back gardens black and very difficult to clean, as does the amount of leaves that fall in the autumn, which all collect in their gardens as there isn't anywhere for them to blow away 2) We have 4 identical sycamore trees or similar height, all in a row (numbered 4, 6, 8 and 9). The canopies all touch when in full bloom, so we feel that removing 6 and 8 will have a minimal effect on the visual appearance of the canopy when viewed from a distance, given that the trees are so closely located together. 3) We ideally would like to create a 'wild' area in that part of the garden, to attract butterflies, bees and other wildlife as well as a vegetable patch for the children, but the extreme shade caused by these two trees makes this challenging.

There are 2 trees that require works - a Taxus (yew tree) and a IIex (holly tree). Both trees require crown lift to provide 3m clearance for pedestrians on public payment and to provide more light into the garden. Also need to relieve pressure of limb from a retaining wall. Crown thinning (10-20%), and prune to clear phone.

Large Copper Beech Tree (Tree 1) on front of No30. Blocking a large amount of light to property and a poorly lit street, request a sympathetic canopy thin (20%) of small diameter branches. Branch causing pressure on phone line to customers house, remove of branch to prevent future problems. Minor deadwood removal from top of canopy (exempt works). Large Leylandii (Tree 2) on neighbouring property requested to be removed to ground due to complaints on both sides. (Destroying lawn on customers side and overhanging heavily on the other.)

TPO350: Sycamore (T1-T4) Large mature sycamores within a confined residential setting. Lower branches are encroaching into neighbouring gardens and towards nearby buildings. The proposed works involve lifting and selectively reducing the lowest branches to provide reasonable clearance from boundaries and structures. Works will be carried out using target pruning to suitable growth points, retaining the trees' natural form, amenity value and overall crown structure. The works are considered proportionate and appropriate to manage encroachment, improve the relationship between the trees and surrounding properties, and reduce the need for more extensive pruning in the future. T1: Remove the two lowest encroaching branches back to the main stem. T2 & T3: Remove the two lowest encroaching branches back to the main stem and reduce the next three branches by approximately 2 to 3 metres using target pruning. T4: Remove the four lowest encroaching branches back to the main stem and reduce the next three branches by approximately 2 to 3 metres using target pruning. T5 Ash (self-set): Reduce branches as necessary to provide 3 metres clearance from the building and roofline using target pruning.

There is a large evergreen tree (holly tree) on the boundary between the back of our house and Burnham House on 6 Elm Bank, Nottingham NG3 5AJ. It is not subject to a TPO. The neighbours had the tree reduced in height some time ago, but since then, the branches of the tree have grown considerably and cross the boundary line by 1 metre or more. I would like to prune the overhanging branches back to the boundary line. The neighbours have been informed of my intentions.

Tree Code: Sgl/106736 Species: Beech (Fagus sylvatica) TPO: TPO269 (T10) Works Sectionally fell and remove the Beech tree to ground level. Remove all timber, branches and arising debris from site. Grind out or otherwise remove the stump where practicable, or leave at ground level as directed by the client. Reason for Works The tree is exhibiting significant structural defects and decay, including: Evidence of substantial basal decay associated with fungal activity (Pholiota spp.). Hollow sounding stem indicating internal decay. Two very large historic tear-out wounds, including one approximately 5 metres above ground level. Major limb loss and loss of large branches. Abnormal buttressing and trunk form. Stem decay below the crown break. These defects indicate a significant decline in structural integrity and an increased risk of partial or whole-tree failure. Summary 1 × Beech (Fagus sylvatica) Sectional dismantling and removal of the entire tree due to advanced structural defects and decay.

Treat stump with approved herbicide plugs following felling. Remove all arising debris from site. Reason: Significant decline and dysfunction. Basal cavity, stem decay, dieback, included bark unions and extensive longitudinal wounding. Scots Pine (Pinus sylvestris) Tree Code: Sgl/033404 Works: Crown lift to 3.5m above ground level. Remove low branches overhanging headstones to improve clearance. Scots Pine (Pinus sylvestris) Tree Code: Sgl/033410 Works: Crown lift to 3.5m above ground level. Remove low branches overhanging headstones to improve clearance. Holly Group (Ilex aquifolium) Tree Code: Grp/925009 Works: Crown lift five trees to provide approximately 3.5m clearance over the highway. Remove low overhanging vegetation to maintain road clearance. Elder (Sambucus nigra) Tree Code: Sgl/925012 Works: Remove the limb closest to the building. Achieve and maintain a clear separation of 1-2 metres between the canopy and the building. Final pruning cuts to be 150-300mm diameter as appropriate. Summary of Works 1 x limb reduction to Scots Pine over neighbouring property. 1 x tree removal and stump treatment (Rowan). 2 x crown lifts to 3.5m on Scots Pines over headstones. 5 x Holly trees crown lifted to 3.5m for highway clearance. 1 x branch removal from Elder to provide building clearance. Total: 11 trees affected, including one tree removal.

Create a 1.5m clearance from both properties. Reason: The tree has had some previous pruning works. Thetree has recovered well and all wounds healedalong with good stable recovery growth. There hasbeen a big tear out in the upper canopy 3 yearsago. This has healed well. No outward signs ofdistress and good uniformity with the crown andmain structure. Tree is protected under TPO 55 reference T4.
