What refusal means

The process from here

The council refused this application for the reasons set out on the decision notice, which the council portal holds in full. Only the applicant can appeal a refusal; the time limit runs from the decision date and is shorter for householder schemes.

Refusal does not prevent a fresh attempt. Applicants often address the reasons for refusal and resubmit, so a refused scheme is not necessarily the end of proposals for the site.

About lawful development applications

How this application type works

A lawful development certificate is a legal determination, not a planning judgement. It asks the council to confirm either that existing use or works are lawful, often through the passage of time, or that a proposal would not need planning permission at all. The applicant must prove the facts; the merits of the scheme are not considered.

T1 - Yew. The tree is positioned to the side of the property, It has now grown very large for the area that it is situated in. Overhanging the roof and touching the side walls of the property. After consultation with our client, she would like to reduce the yew back to a main trunk of approximately 8 foot. Then allowing the yew to regenerate and once to some size again to be hedge cut annually to create a ball shape in keeping with the size of the area.

Permission is sought to remove and grind out up to 9 tree stumps on the 15 Post Office Lane side of a boundary shared with 4 Baker?s Lane. The stumps are up to about 6 feet high, and are the remnants of hawthorn trees which were previously 15-30 feet high, which were previously cut to 6 feet high without permission. The stumps are to be removed prior to the planting of new trees to restore privacy along the border, with a view to proving the new trees with the best chance of survival. The attached Google Earth image shows the location of the stumps, indicated by the two white dots and the joining yellow line. The road shown towards the bottom of the image is Bakers? Lane, towards the top Post Office Lane.
