Section 54 application to vary Conditions No. 2 (Phasing Plan), No. 9 (Landscape Works) and No. 10 (Tree Protection) of Planning Approval LA05/2020/0048/F to allow amendments to the parking and landscaping layout. Vary Condition No. 2 from: The development hereby permitted shall be carried out in accordance with the approved Phasing Plan detailed on drawing number 30 bearing the Council date stamp 17 January 2020 . No part of these hard surfaced areas shall be used for any purpose at any time other than for the parking and movement of vehicles. To: The development hereby permitted shall be carried out in accordance with the approved Phasing Plan detailed on Drawing Ref: DIIB-ACMXX-XX-DR-AR-07000. Vary Condition No. 9 from: All hard and soft landscape works shall be carried out in accordance with Drawing No.'s 33, 34 and 35 bearing the Council date stamp 17 January 2020 and the approved details. The works shall be carried out no later than the first available planting season after occupation of that phase of the development. No retained tree shall be cut down, uprooted or destroyed, or have its roots damaged within the crown spread nor shall arboricultural work or tree surgery take place on any retained tree other than in accordance with the approved plans and particulars, without the written approval of the Planning Authority.     The proposed amendments comprise a combination of interim changes to enable an Operational Phase 1 of the development, together with a small number of permanent design adjustments.
