Planning application

P242172/J

Lutian House Cradley Malvern Herefordshire WR13 5NF

Granted Herefordshire, County of Works to trees covered by TPO

Proposal

Oak TPO Ref. 027183 We would like to reduce the intermediate canopy tobring it in line with the lower canopy. Further, Oak TPO Ref. 027183 contains dead wood that overhangs the highway C1162 and some of the driveway of Penny Cottage. To increase safety for road users and the residents of Penny Cottage, we wish to remove this dead wood at the same time as executing the other tree work. Oak 9 metres due south of TPO Ref. 027183 and within the Cradley Conservation area. To reduce the branches on the western side to remove overhang of the garden of Penny Cottage.

What a grant of permission means

The process from here

Permission has been granted, usually subject to conditions listed on the decision notice, some of which must be discharged before work starts. The decision notice on the council portal sets out exactly what was approved.

Work must normally begin within three years of the decision or the permission lapses. Neighbours cannot appeal a grant; challenging one means judicial review of how the decision was made, within tight time limits.

About trees applications

How this application type works

Tree applications cover work to protected trees: those under a tree preservation order need consent for pruning or felling, and trees in a conservation area need six weeks written notice before work starts. The council assesses the amenity value of the tree and can refuse consent, approve it with conditions, or in conservation areas make a preservation order in response.

Oak tree (T1) - Advised reduction pruning to reduce domination of Bulls Head Cottage (adjacent property), and to restore a more balancedcrown. Works to include: removal of two bottom limbs over Bulls Head Cottage; reduction of south, west and east sides by 4m.; reduction of height by 4m. Concerned that the unbalanced shape of the tree could lead to it falling, or shedding heavy limbs causing serious damage to Bulls Head Cottage building and occupants; also a footpath used by members of the public passes directly beneath the tree canopy and thisconstitutes another cause for our concern of safety of others.
