The tree is the single pine tree (30/T26) at the property; the works involve underpinning the nearest parts of the property to the tree to a depth as explained in the method statement - the precise depth depends upon the depth of roots found. This work does not need planning permission based on the Town & Country Planning Act s55(2)(a) definition of development. However, the works will cut roots of the pine tree & thus this application is submitted in case the council consider it necessary. These works are necessitated as a result of refusal of tree works application 23/00806/TPO. The reason for the works are due to root-induced clay shrinkage subsidence. In the event this application is refused then a more expensive engineering option (e.g. a piled raft) will be necessary although it may have no significantly less impact on the pine tree. The reasonably foreseeable loss arising from the council's refusal of this application may be as much as £200,000 as alternative accommodation for several months will be required.
