Works: Extension Windows or glazing

Still open. Anyone can comment while the consultation period runs, and comments go to the council rather than to us.

Proposal

Replaced skylight on rear extension roof. ,Previous skylight timber framed, had x3 window panes and was single glazed. Replaced by a new timber framed skylight with x2 panes and is double glazed. Outside appearance is very similar; before and after photos can be provided. Prior to the works being carried out I reviewed the council online guidance and although the building is grade C listed it is not in a conservation area and therefore permission was not sought.

What happens while it is decided

The process from here

This application is with City of Edinburgh for determination. The council publicises it, consults neighbours and technical bodies where required, and weighs the responses against local and national planning policy.

The statutory target is eight weeks for most applications and thirteen for major development, though extensions of time are common. Comments carry most weight while the case is undecided, so check the council portal for the deadline if you want to respond.

About lawful development applications

How this application type works

A lawful development certificate is a legal determination, not a planning judgement. It asks the council to confirm either that existing use or works are lawful, often through the passage of time, or that a proposal would not need planning permission at all. The applicant must prove the facts; the merits of the scheme are not considered.

The land behind 5 Harrison Road has been in use as my garden since 1984 when I developed it (i.e. from when I purchased the house). It is a fenced-in plot of land similar to all other garden plots in the street. It contains mature plants, trees and lawn. There are no structures (except the fencing) on the land. I understand that the garden appears on the council mapping since that time.
