Application for a prior approval the change of use of the first floor of Moor House from office (use class B1(a)) to a dwellinghouse (use falling within use class C3).NB: A breach of permission 15/00190/PAC exists on the development:Written approval under the Article 6(3) of the Habitats Directive (Council Directive 92/43/EEC) and Regulation 61(5) of the Conservation of Habitats and Species Regulations (2010) as amended has not been sought from the Local Planning Authority (Bracknell Forest Council) and the owners of the land have not entered into a Council approved Section 106 Legal Agreement to provided financial contributions to mitigate the developments impact on the Thames Basin Heaths Special Protection Area .This development or any part thereof, cannot be occupied until a S106 Agreement has been entered in to with Bracknell Forest Council and the Council has received and applied the financial contributions towards Suitable Alternative Natural Greenspace (SANG) and the Strategic Access Management and Monitoring (SAMM) project in accordance with summary table 1 in the BFBC Thames Basin Heaths Special Protection Area Avoidance and Mitigation Supplementary Planning Document. This ensures compliance with the Conservation of Habitats and Species Regulations 2010 (as amended). Liabilities for compliance with these obligations will pass to all parties taking an interest in the development, should any occupation take place.Dated: 13/04/16
