Discharge of condition 34 of LA08/2023/2031/F which reads: No development shall take place until a Wastewater Impact Assessment has been submitted to and approved in writing by the Council, in consultation with NI Water, with the Wastewater Impact Assessment demonstrating that the development can be served by the public sewerage system or that acceptable alternative provision for disposal of sewerage has been made. Any mitigation measures contained therein shall be implemented prior to the commencement of the development herby permitted, or in accordance with a programme to be submitted to and agreed in writing with the Council.

    Discharge of Condition No. 23 & 24 of planning approval LA08/2023/2031/F which state: Condition number 23: If during the development works, new contamination or risks are encountered which have not previously been identified, works shall cease and the Council shall be notified immediately. The plan shall set out the period of the plan, long term objectives, management responsibilities, performance measures and maintenance schedules of all areas of landscaping and open space as shown on Drawing Nos. 02D and 40B. It shall also set out details of the arrangements that will be put in place for the future management and maintenance in perpetuity of these areas, including details of the legal agreement, between the prospective residents and Management Company, which are to be put in place as per policy OS 2 of PPS 8. The landscape and open space management plan shall be carried out as approved unless prior written consent is granted by the Council to any variation. There shall be no demolition of buildings or vegetation clearance, during the bird breeding season (1 March to 31 August inclusive), unless a competent ecologist has undertaken a detailed check for active bird nests immediately before clearance and written confirmation that no nests are present, no birds will be harmed and/or there are appropriate measures in place to protect nesting birds and evidence of this has been provided to and agreed in writing with the Council prior to their removal.
