It shall also set out details of the arrangements that will be put in place for the future management and maintenance in perpetuity of these areas, including details of the legal agreement, between the prospective residents and Management Company, which are to be put in place as per policy OS 2 of PPS 8. The landscape and open space management plan shall be carried out as approved unless prior written consent is granted by the Council to any variation. There shall be no demolition of buildings or vegetation clearance, during the bird breeding season (1 March to 31 August inclusive), unless a competent ecologist has undertaken a detailed check for active bird nests immediately before clearance and written confirmation that no nests are present, no birds will be harmed and/or there are appropriate measures in place to protect nesting birds and evidence of this has been provided to and agreed in writing with the Council prior to their removal.
