Decided Amber Valley TRE/2020/0656 Trees

Works: Trees Small domestic

Read from the description, not a valuation. How we read the register

Decided. The decision notice on the council portal carries the outcome in full, including any conditions.

Proposal

Cedar Tree (T1) as per TPO 421 / 2017 was severely damaged during storm Ciara on Sunday 9th February 2020, when approximately the top third of the main trunk snapped off and cartwheeled into the grass, ending up with the widest part resting on the boundary wall overhanging next doors garden (17 Champion Hill). The shrub border, with fruit trellis was destroyed, and our custom made wrought iron rose trellis on the wall damaged. The greenhouse required re-glazing, re-guttering and metal roof frame re-aligned. We originally applied for the tree to be removed or pruned in 2017, but this resulted in the TPO being applied. At the time we remained very concerned that it was such a large tree it was no longer compatible with our garden. For example, it casts a huge shadow over the rest of our garden (situated as it is at the south end of the plot), has affected the health of our apple trees and other plants, and would severely damage 15 Champion Hill should it fall in a southeasterly direction. The tree was listed because it was considered to be a feature of the local landscape and a good specimen. Currently it now has a shattered trunk tip with a large branch emerging just below which could be more liable to now drop, and the tree as a whole now looks an odd shape. We submit that it is no longer safe nor healthy, and remains unsuitable for a small residential garden. We do like trees in the garden (for example the custom made rose trellis mentioned earlier was fashioned to accommodate another evergreen tree in the border), and so would like to replace the damaged cedar with a more appropriate deciduous tree, for example a Mulberry or Medlar, at or as near to as possible the removed tree.
