T2 Dead Malus Proposed Works: Fell to ground level by sectional dismantling. The Malus is dead and has no realistic prospect of recovery. The tree has suffered complete physiological failure and no longer contributes to the visual amenity of the area. As decay progresses, the structural integrity of the stem and branches will continue to deteriorate, increasing the likelihood of branch or stem failure. The proposed removal is considered appropriate in the interests of public safety and good arboricultural management. As the tree is dead, the works fall within the exemption for dead trees under the Town and Country Planning (Tree Preservation) (England) Regulations 2012. T1 Arbutus Proposed Works: Fell to ground level by sectional dismantling. The Arbutus is located in an unsuitable position immediately adjacent to the boundary wall, where it has insufficient space to develop to its natural size and form. The close proximity of the stem to the masonry wall has created an ongoing conflict between the tree and the built structure. As the tree continues to mature, the likelihood of structural damage to the wall and associated hard landscaping will increase. The restricted rooting environment and lack of available growing space also limit the tree's long-term suitability for retention. The proposed removal represents the most appropriate long-term arboricultural solution, eliminating the existing conflict with the boundary structure and allowing replacement with a more suitable species that can be accommodated within the available space. The works are considered reasonable and proportionate, having regard to the size of the garden, the location of the tree and accepted principles of good arboricultural management.
