What refusal means

The process from here

The council refused this application for the reasons set out on the decision notice, which the council portal holds in full. Only the applicant can appeal a refusal; the time limit runs from the decision date and is shorter for householder schemes.

Refusal does not prevent a fresh attempt. Applicants often address the reasons for refusal and resubmit, so a refused scheme is not necessarily the end of proposals for the site.

About householder applications

How this application type works

Householder applications cover work to an existing house and its garden: extensions, loft and garage conversions, porches, outbuildings and similar alterations within the boundary of the home. They cannot be used to create a separate dwelling or change what the building is used for. Councils aim to decide them within eight weeks, and immediate neighbours are usually notified and given a chance to comment.

T1 ??? Oak (Quercus spp.) ??? Undertake selective crown management works including the removal of dead, damaged and defective branches throughout the canopy and selective pruning of crossing and rubbing branches where appropriate. Carry out a light crown thin to improve light penetration through the canopy whilst maintaining the tree's natural form, amenity value and physiological health. No more than 15% thinning from branch ends. T2 ??? Southern Magnolia (Magnolia grandiflora) ??? Undertake routine tree maintenance works including removal of deadwood throughout the crown and light formative pruning to improve crown structure and encourage healthy future growth whilst retaining the tree's natural shape and ornamental characteristics. T3 ??? Lime (Tilia spp.) (Neighbouring Tree) ??? Reduce branches overhanging the applicant's garden back to suitable growth points (2m from branch ends) in order to contain growth within the available space, improve light penetration to the rear garden and maintain an appropriate relationship with neighbouring land use.

    12 Briar Walk SW15 6UD

A two-trunk Common Holly tree stands at the southern corner of our property, 12 Briar Walk, neighbouring 14 Briar Walk (see tree T1 in attached sketch plan). The tree has an extensive and vigorous root system above ground (see photo), while the root system below ground appears to be causing damage to the dividing garden wall between 12 Briar Walk and 14 Briar Walk (see photos showing cracks). Our neighbours at 14 Briar Walk are concerned about the potential for further damage to the dividing wall and have asked us to remove the tree. We plan to employ professional tree surgeons to cut down the tree and minimise or prevent future growth of the root system. We have no plans to repalace the tree.
