The Links Petitor Road Torquay TQ1 4GE
EXEMPTION NOTICE T1 Horse Chestnut: Fell to near ground level. I am writing to inform you that we intend to remove the tree in question on 6th of January 2026. The horse chestnut has suffered two recent major limb failures within the last few months, which caused damage to property. Inspection of the failed limbs shows extensive internal decay, with the wood at the point of failure being completely rotten. The tree exhibits fungal brackets indicative of significant internal decay. Given the history of failure, the presence of advanced decay, and the proximity of property, the tree presents a foreseeable risk of serious harm. Further limb failure is considered likely and cannot be reliably mitigated through pruning. The local Tree Officer has been consulted and has confirmed that removal is acceptable under the dangerous tree exemption. Replacement tree: The tree is located within a confined raised bed enclosed by a stone wall. Following removal, the stump and associated root plate will occupy the majority of the available space. Stump removal would require significant excavation and disturbance to the surrounding structure and hard landscaping, resulting in disproportionate cost and disruption. For these reasons, on-site replacement planting is not considered practical. The applicant intends to plant shrubs and ornamental plants suitable for the available soil volume around the stump.

43 St Georges Road Torquay TQ1 3QY
Horse chestnut (T1) Proposed works: Crown lift of low branches to achieve a clearance of approximately 4m above ground level with cuts no larger than 50mm. Works are required to alleviate obstruction and encroachment onto the adjacent highway, driveway, garden, and property areas directly beneath the crown. Specification: All operations to be carried out in accordance with BS 3998:2010 (Tree Work ? Recommendations). Removal is limited to lower-order branches that impede access and damage the arrangement of first-order branches beneath the crown dripline. Works will maintain tree health and form, focusing on clearance rather than reduction. Supporting context: A similar consent was granted in 2015 due to the tree?s asymmetrical crown interfering with neighbouring vegetation. Current encroachment affects a well-established Japanese maple (SW) and Laurus hedge (E), both of which will benefit from reduced competition for light and space. Intervention will prevent further damage to the lower crown and improve coexistence with adjacent plantings. Reason for works: To ensure safe clearance above the highway and driveway, reduce interference with neighbouring vegetation, and maintain the long-term health and structural integrity of the tree.

Oak (T1) - Reduce the outer crown to the NW and SW by up to 1.5 m, ensuring final cuts do not exceed 50 mm diameter. The resulting crown spread will be approximately 6-7 m from stem to crown edge in each direction, in accordance with BS 3998:2010. The tree is situated near No. 18, adjacent to a bus stop and car park within a landscaped garden. Works are proposed to mitigate nuisance from bird droppings on the patio, which pose a potential health risk, while retaining the tree's amenity and structural integrity. The proposed works are necessary to mitigate nuisance and health risks arising from bird droppings on the patio, which can act as breeding grounds for parasites transmissible to humans. The tree's proximity to a bus stop and landscaped car park increases public exposure, making crown management essential for safeguarding amenity and public health. Selective reduction of the NW and SW crown will lessen overhang and shading, while retaining the tree's overall form and structural integrity in accordance with BS 3998:2010. The works will ensure that the crown maintains adequate clearance above the adjacent car park, consistent with the minimum highway clearance standard of 5.03 m. This is particularly important given the restricted manoeuvrability for larger vehicles near the bus stop, where safe passage must be maintained for public transport, service, and emergency vehicles.

T001 - 1x Holly Tree Crown lift on the roadside by removing three branches overhanging the carriageway, pruning back to the main stem to achieve highway regulation clearance of 5.60 metres from road level. Reduce the remaining canopy of the tree as follows: Reduce the height of the tree by approximately 2 m, leaving a final overall height of approximately 7 m. Reduce the radial crown spread by approximately 1.5 m, leaving a final radial spread of 5.5 m at all compass points. All works shall retain the tree's main framework and natural form, maintaining a high proportion of the foliage-bearing structure. All final pruning cuts shall be made at suitable growth points in accordance with BS 3998:2010 Tree Work ? Recommendations. Individual pruning wounds shall not exceed 40 mm in diameter. Justification: The proposed works are intended to provide adequate statutory highway clearance in accordance with Section 154 of the Highways Act 1980 and to prevent low lateral branches from obstructing the carriageway. The crown reduction is required to contain the overall size and spread of the tree within its constrained roadside setting, mitigating the risk of branch failure and limiting future encroachment into the garden area. The works are of a sympathetic and proportional nature, designed to maintain the long-term health, form, and amenity value of the tree while ensuring compliance with highway safety regulations. The proposed pruning is consistent with good arboricultural practice and will not adversely affect the tree's physiological condition or visual contribution to the local landscape or conservation area.

Copper Beach Tree near entrance to drive on the left hand side of the entrance as you face the house. Tree has grown very large and we have been advised by a tree surgeon that it has signs of fungus on quite a few branches which appear to be consistent with the fungus biscogniauxia nummularia on branches that hang over the road. Therefore the tree could be dangerous in high winds as branches could come off and fall onto the road to hit cars or people. So please can we take the tree down completely.
