What refusal means

The process from here

The council refused this application for the reasons set out on the decision notice, which the council portal holds in full. Only the applicant can appeal a refusal; the time limit runs from the decision date and is shorter for householder schemes.

Refusal does not prevent a fresh attempt. Applicants often address the reasons for refusal and resubmit, so a refused scheme is not necessarily the end of proposals for the site.

About householder applications

How this application type works

Householder applications cover work to an existing house and its garden: extensions, loft and garage conversions, porches, outbuildings and similar alterations within the boundary of the home. They cannot be used to create a separate dwelling or change what the building is used for. Councils aim to decide them within eight weeks, and immediate neighbours are usually notified and given a chance to comment.

Monterey Cypress (T1) - Reduce the crown by approximately 2 metres on the eastern side only to correct the developing structural imbalance and to reduce the likelihood of further branch failure, supporting the tree's health and stability. All reduction cuts will be made back to appropriate lateral growth points, and no pruning wound will exceed 50 mm in diameter. All works will be undertaken in accordance with BS3998:2010 - Tree Work Recommendations, ensuring compliance with industry standards and regulations. This selective reduction is necessary to maintain the tree's stability, structural integrity, and safety, especially following the recent stem failure and loss of shelter from neighbouring trees.

T1/2/3 Monterey Cypress (group of 3) It is proposed to fell the three Monterey cypress trees within Group G1, leaving standing monoliths at approximately 1.5 metres above ground level to match the height and appearance of adjacent retained trees. The trees are highly exposed and have a history of limb failure during periods of high wind over the last 2 years. Ongoing branch loss presents an increasing risk to the client's property, neighbouring property, and the adjacent railway line.

The mixed broad-leafed woodland that the client manages has number of ash trees with all stages of ash dieback. The trees are very tall and near houses at the bottom of the woods. The best option would be to take out all the Ash trees leaving the other broad leaf species to strive. All procedures would be carried out to the BS3998 and dismantling would be done out of nesting season. Please see photo attached of works to be carried out.
