Granted Torbay AT/2024/0332 Works To Tree Within CA

Works: Trees

Permission granted. Work must normally begin within three years of the decision or the permission lapses.

Proposal

PLEASE NOTE - TREE NUMBERS RELATE TO ASPECT TREE CONSULTANCY PLAN (03972 TLP), NOT TO NUMBER ON TPO SCHEDULE T1 ? Monterey cypress: Crown spread SE to 4m above ground level. Remains of eastern stem present, decayed but of limited significance. Crown lift on eastern side of tree removing: 1) Two lowest branches 100mm in diameter originating at 4m and 4.5m above ground level. 2) NE primary limb originating at 4.5m above ground level - remove two lowest secondary branches originating at 1m from base of the branch (the lowest one has a split 2m from trunk and the other is 20cm above it). 3) NE Primary limb, secondary branch growing east 1m from trunk 100mm in diameter and tertiary branches growing east up to 5m above ground level from underside of branch. 4) Remove lowest branch N growing in a NNW direction toward house, which is over the roof of the extension, originating at 6.5m above ground level from second lowest primary branch, maximum 100mm in diameter. 5) Tertiary branches SW at 4.5m above ground level 50mm in diameter. All pruning is in accordance with BS3998 and relates to less than 5 to 8% of total crown volume. Reasons: To provide reasonable clearance of the house, garden, ancillary structures and the neighbouring property. The works accord with BS 3998 2010 Tree Work - Recommendations and the extent of foliage / bud removal do not exceed national guidance. The trees physiological condition is good, and the works will not lead to decline in the tree?s health. The size of pruning cuts will not allow heartwood decay to develop. The works will not affect the trees visual amenity value. T2 Lime: Crown lift and/or crown reduce to include: 1) Crown lift to 4m above ground level removing tertiary and secondary branches only and maximum 75mm in diameter (some parent branches are 100mm but prune back to nearest growth point at 75mm in diameter) up to 5m above ground level. 2) Reduce lowest primary east originating at 4m above ground level by 4m f...

T1 - Beech - Crown lift by approximately 2 metres removing up to 30 minor secondary branches to provide clearnance while retaining a natural and balanced form. T2 - Beech - Lateral reduction of the crown by 1-2 metres to leave an approximate final spread of 6 metres with all pruning cuts made back to suitable growth points. T3 - Holm Oak - Lateral crown reduction by up to 1 metre leaving an approximate final spread of 5 metres, maintaining natural shape and tree health. Justification for proposed works. T1 - Beech - The tree has developed low-hanging branches with excessive lateral weight increasing the risk of branch failure. A minor crown lift will help reduce loading stress while improving clearance and maintaining tree health and form. The proposed works are proportional and preventative. T2 - Beech - The crown is growing in close proximity to the building with lateral spread approaching the structure. Selective lateral reduction will prevent future conflict with the property, minimise risk of damage and maintain a safe management distance while retaining the tree's natural shape. T3 - Holm Oak - This tree is also spreading toward the building and requires a light lateral reduction to prevent obstruction and potential contact with the structure. The work is preventative and intended to avoid future damage, shading and maintenance issues. All works are minimal, sympathetic and designed to retain natural form while preventing future structural or safety-related issues. The works are considered appropriate tree management rather than aesthetic alteration.

Fell fraxinus (ash) on the front road side of clients property. The ash tree overhangs the road and public foot path with a high volume of traffic. The tree a multi stem small tree with ash die back and is visible from Mathews road the tree has low Amenity We are applying to fell the tree to remove risk of tree failure over path road ahead private garden. All tree work will be carried out to bs3998. The client intendeds to replant on the property. Proposal of a replacement lime tree in the same location to the ash tree.

Oak T1 - Selective reduction of the NE and SE crown overhang to achieve adequate clearance above the adjacent public access lane, in line with the minimum highway clearance standard of 5.03 m. This is particularly important given the restricted manoeuvrability for larger vehicles near the bus stop, where safe passage must be maintained for public transport, service, and emergency vehicles.

Crown lift secondary branch growth only up to approximately 4.5m from ground level to achieve the required vertical clearance above the driveway and neighbours. Crown thin overall leaf bearing twig structure by 10 percent. This will also help with canopy crowding and avoid other trees rubbing against each other. Remove all major dead wood from crown All trees are Fagus Sylvatica (Mature Beech) This work has been previously accepted in 2023, application submitted by Devon Tree Services and works were completed by them as well.

T1 Mimosa Proposed works: Fell Mature Mimosa situated within a confined residential garden in a Conservation Area, immediately adjacent to a masonry boundary wall and nearby buildings. The presence of Ganoderma fruiting bodies at the base of the tree indicates a potential wood-decay infection. The tree also exhibits an irregular crown with apparent dieback and is growing within a severely restricted environment. Its proximity to residential property, garden areas and the public highway increases the potential consequences of structural failure. Felling is proposed on the grounds of suspected basal decay, apparent crown deterioration and the tree's restricted location.

T1 - Holm Oak Recommended works: Establish a pollard framework by removing the three substantial lateral branches at the positions indicated by the red markings in Photograph 3. The proposed works are intended to reduce the extensive lateral crown and associated mechanical loading from the tree's pronounced lean, while retaining the tree. Cyclical management: Following establishment, implement a seven-year cyclical pollarding regime to manage regrowth, control crown size, and limit excessive loading on the retained framework. Inspect the developing pollard heads periodically, particularly during the initial establishment period, to assess shoot attachment, structural condition and physiological response. All works should be undertaken in accordance with BS 3998:2010, subject to confirmation that the proposed cutting positions and degree of crown removal are appropriate following an on-site assessment. The seven-year interval is the proposed management objective and should be reviewed based on the tree's regrowth and structural condition.

T1 - Western Red Cedar Proposed works: Fell Reason for works T1 is an established Western red cedar growing in exceptionally close proximity to an existing stone boundary wall. Photographic evidence indicates that the lower stem is in direct contact with the masonry, creating a physical conflict between the tree and the structure. Continued radial growth of the stem could exert further pressure on the wall, resulting in progressive displacement and deterioration of the masonry. The close relationship between the stem and the wall also restricts access for inspection, maintenance and necessary repairs. The tree's position presents a long-term management conflict. Crown reduction would not resolve the fundamental issue at the base of the tree, as it would not prevent continued radial stem growth. Felling is recommended as a permanent way to resolve the physical conflict between the tree and the boundary wall, prevent further interference from stem growth, and facilitate any necessary structural repairs. This recommendation is based primarily on the tree's unsuitable position relative to the existing structure and the limited practical options for a sustainable long-term solution. Based on its apparent size and maturity, it is possible that the tree was planted after the original Tree Preservation Order (TPO) was established.

Holm Oak 12m Tall 50cm diameter (Already have approved plan for other three trees on site, scope to mirror that) Crown mai fence works requested to cut back to previous pruning points, not as far as original pollard but to the secondary pollard points, this has been noted on tree inspectors recent visit looking at other trees on site. This tree was not included in the original request due to a miscommunication between owner and agent. Plan to reduce radial spread down from 9m to 7m roughly removing 1.5-2m of regrowth.
