Deed of variation to the Section 106 agreement associated with planning permission 21/AP/1806 to amend provisions relating to payment in lieu Introduction of a new definition of Outstanding Payment in Lieu as the unpaid balance of the Payment in Lieu at any given time. Amendment to the definition of Index to apply RPIX (excluding mortgage interest), with a cap of 4% on the total indexed increase of the Payment in Lieu. Inclusion of a provision enabling the Payment in Lieu to be made in instalments in accordance with Schedule 1. Inclusion of a provision allowing 100% occupation of residential units for private rented use pending payment of the outstanding contribution in accordance with the agreed payment arrangements.
