Modification of S106 agreement relating to DM/20/4692 - Vary the tenure for the First Homes units to Affordable Rented units and corresponding obligations. Amend the Mortgagee in Possession clause at Paragraph 8 so it is suitable for charging at MVST. Insert an express provision allowing the rents to be increased by CPI + 1% per annum. Amend the enforceability clause at clause 9 to also exclude the Registered Provider and their mortgagee from the non - affordable housing obligations. Amend the exclusions clause to expressly exclude liability in respect of the affordable housing obligations from tenants who have exercised a right to buy, right to acquire, preserved right to buy or their mortgagees.
