Section 54 application to remove condition 10 of planning approval LA05/2017/0741/F: "No dwellings shall be occupied until the access path as coloured in pink on Drawing 02B date stamped 21st August 2018 has been constructed. Reason: To ensure access is provided to the adjacent open space area in the interests of residential amenity". Reason for removal: The key rationale is that planning was not approved for the regional park and no formal leisure / amenity space with safe access has been developed. Also the location of the pathway is not safe or appropriate based on the topography of the site. It is expected that any future access will be at an appropriate location along the shared eastern boundary of Breton Hall and the open space and will reflect the nature of the overall Breton Hall development and the level of expected pedestrian traffic.
