Although the applicant selected both TPO and Conservation Area on the application form, the submission was not accompanied by the technical information required under the Town and Country Planning (Tree Preservation) (England) Regulations 2012 (SI 2012 No. 605). Accordingly, the form was incorrectly validated and cannot be treated as a valid application for consent. A formal TPO application supported by appropriate arboricultural evidence and justification for the proposed works must be submitted before the Council can lawfully determine the application.
