Please see attached the photos and the oak tree marked in red. As you can it almost sits between communal path and flat 3 garden right now, and it overhands my boundary line with its lower branches. As you can see from the photo the oak tree is well over 6 metres high and my fence is only 1.65m so we will be cutting only lower branches to allow the fence to be installed.
