What withdrawal means

The process from here

The applicant withdrew this application before the council decided it, so it carries no planning weight and no fee refund is automatic. Withdrawal often follows officer feedback that a refusal was likely.

The applicant is free to submit a revised application at any time, and many withdrawn schemes return in amended form, so the site is worth watching if the proposal affected you.

About lawful development applications

How this application type works

A lawful development certificate is a legal determination, not a planning judgement. It asks the council to confirm either that existing use or works are lawful, often through the passage of time, or that a proposal would not need planning permission at all. The applicant must prove the facts; the merits of the scheme are not considered.

Proposed Works T1 ? Sycamore Reduce canopy by approximately 20% (1?2m). Avoid large-diameter cuts. Maintain a balanced structure and natural form. T9 ? Beech Reduce overall height to align with the reduced sycamore (2?3m). Reduce lateral branches by approximately 1m. Undertake a 10% canopy thin to improve light penetration. T2, T3, T4, T5, T6, T7 & T8 ? Coniferous Trees/Shrubs Fell and remove all specified coniferous trees/shrubs. Stump grind to below ground level. Works to facilitate replanting with more suitable species. Justification for Works: T1 (Sycamore) & T9 (Beech): Works are proposed to improve light penetration into the garden, supporting the growth and establishment of understory planting and other vegetation. T2?T8 (Coniferous group): Removal is recommended due to their close proximity to the property / retaining wall and to create space for replanting with species more suitable to the site context.

T1 - Silk Tassel bush: Fell Reasons: This tree is growing close the wall of the property. It is not a big tree, and fairly insignificant in terms of the the amenity value of the area, and not visible from the road. Replanting of a similar species of tree is advised further from the wall of the property, so that it will have space to mature and form a natural habit. T2 - Variegated Holly: Fell Reasons: There is a fairly significant area of decay at the base of the tree, which has caused dieback in the crown. It does have amenity value, situated near the road, but is in decline. The decay is likely to continue to reduce the vigour of the tree, and cause eventual death. So it will be a better strategy to replant a variegated Holly somewhere near this spot, and possibly further out from the corner of the house to provide space to mature.
