Refused Elmbridge 2025/0938 Tree Preservation Order

Works: Trees

Refused. Only the applicant can appeal, within the statutory time limit, and a revised scheme can be submitted instead.

Proposal

Tree Preservation Order EL:05/11: T1 - Spruce - fell to ground level - tree is located in the decked area of the pub garden that is used by patrons for outside seating. Tree roots are lifting decked area which is causing a trip hazard. In addition to this the tree is dropping needles onto the tables as well as providing a home for birds that are defecating onto the tables and decking. This is affecting the business of the pub particularly during the summer months.

Tree Preservation Order EL:05/11 - T1 - Spruce tree. This tree stands at approximately 25m tall and is approximately 6m from the building. To fell the tree because it has outgrown its current position and it is clear it has large lateral roots because it is lifting the decking. This tree is continuing to grow (approximately 40m at maturity) and the roots will be growing too close to the Grade II listed building. There is also a health and safety issue with the tree because it is shedding cones on a regular basis onto the decking where people are eating. We would like to replant a native decorative tree which would be maintained and not grow to the height of this tree and therefore not encroach onto the listed building.

Tree Preservation Order EL:18/07 - T1 - Horse chestnut - Proposed Works: Crown lift over the roadside only to provide a minimum clearance of 5.2 metres above ground level. All pruning shall be limited to secondary branches where practicable and carried out in accordance with BS3998:2010 Tree Work Recommendations, with a maximum pruning wound diameter of 50mm. Reason for Proposed Works: Following a tree survey, it was identified that the crown over the carriageway has been subject to contact from larger vehicles in the past. The proposed crown lift will provide appropriate clearance for high-sided vehicles, reducing the likelihood of future vehicle strikes and preventing unnecessary damage to the tree, whilst retaining its long-term health and amenity value.
