What a grant of permission means

The process from here

Permission has been granted, usually subject to conditions listed on the decision notice, some of which must be discharged before work starts. The decision notice on the council portal sets out exactly what was approved.

Work must normally begin within three years of the decision or the permission lapses. Neighbours cannot appeal a grant; challenging one means judicial review of how the decision was made, within tight time limits.

About conditions applications

How this application type works

This type of application deals with conditions attached to an existing permission, either by supplying the details a condition requires, called discharging it, or by asking to vary or remove one. It does not reopen the principle of the permission itself. Building often cannot lawfully start, or continue past a set stage, until the named conditions are discharged.

Esher Conservation Area - TG1 Oak and beech - trees have low crowns over the footpath and are growing close to the building, We would like to raise the crown 3m over footpath and prune 2m clear of the building. T1 - sweet Chestnut- 14m high and 6m wide, we would like to remove 2 branches growing into the adjacent yew tree. T2 - Yew - 9m high and 8m wide, tree is becoming to large for the area we would like an holistic reduction of 2m leaving 7m high and 6m wide. T3 - Sycamore- 16m high and 9m wide - tree splits into 2 stems at 2m high, the southern stem has a large cavity, we would like to remove this stem as a matter of safety. TG2 - row of lime and sycamore- 16m high, 8m wide, trees have low crowns over the garden we would like to prune them back in line with the conifer hedge below. Leaving the trees 6m wide.

Esher Conservation Area - T1 Leyland Cypress (Rear Garden) Fell to ground level. Reason for Works: The tree is situated in very close proximity to the adjacent outbuilding. As the tree has matured, the stem has increased to a diameter at breast height (DBH) of approximately 40 cm and is now in direct contact with the structure, causing abrasion and damage to the building. Due to the ongoing increase in stem diameter, further structural damage is considered likely if the tree is retained. The proposed removal is therefore necessary to prevent additional damage while maintaining the safety and integrity of the adjacent structure. T2 Lawson Cypress (Rear Garden) Remove one large declining lateral limb and carry out a crown clean to remove all deadwood throughout the canopy. Reason for Works: A substantial lateral limb is in decline, exhibiting extensive dieback and a significant reduction in live foliage. The removal of this limb is proposed to reduce the risk of branch failure and improve the tree's overall condition. In addition, deadwood will be removed throughout the crown to eliminate potential hazards, improve canopy health, and form part of routine arboricultural management.
