What a grant of permission means

The process from here

Permission has been granted, usually subject to conditions listed on the decision notice, some of which must be discharged before work starts. The decision notice on the council portal sets out exactly what was approved.

Work must normally begin within three years of the decision or the permission lapses. Neighbours cannot appeal a grant; challenging one means judicial review of how the decision was made, within tight time limits.

About lawful development applications

How this application type works

A lawful development certificate is a legal determination, not a planning judgement. It asks the council to confirm either that existing use or works are lawful, often through the passage of time, or that a proposal would not need planning permission at all. The applicant must prove the facts; the merits of the scheme are not considered.

Tree Preeservation Order EL:146 - Tree Species: Sycamore (Acer pseudoplatanus) Height: 24m Trunk Diameter: 1052mm Canopy Spread: NE6m SE4m SW6m NW8m Crown Hight: 9m Mature Tree in poor condition but fair structural condition. Number used in the sketch plan T2 (which matches the tree survey must is not readily identifiable on the TPO). The tree survey identifies T2 as requiring removal on safety grounds. T2 is considered to be U category due its poor physiological and structural condition. The survey identifies poor vitality demonstrated by significant dieback and excessive deadwood. Significant areas of necrotic bark on the southern buttressing and upper root. Significantly decayed upper root at 400mm from main stem connected to 125mm opening with decay and small cavity on south-western buttress. Bark wounds on western buttress. Wound with decay on north-western buttress. Proposed works are to fell tree to ground level. Given the proximity of the T1 to T2, we request that no replacement tree be required. T1 and T2 compete given their proximity and T1 is already leaning toward the neighbouring property (number 48 NE boundary). As you will see from the tree survey, the condition of the remaining 3 trees at the property is category C and they are large trees for the space available.
