The application is for a certificate of lawful development for the placement of a caravan with the curtilage of Edwins Hall Cottage. A site licence shall not be required for the use of land as a caravan site if the use is incidental to the enjoyment as such of a dwellinghouse within the curtilage of which the land is situated, as per the legal references outlined below. Under s 55(2)(d) of the Town and Country Planning Act 1990 the use of any buildings or other land within the curtilage of a dwellinghouse for any purpose incidental to the enjoyment of the dwellinghouse as such is not to be taken to involve development of the land. The proposal comprises the construction of a freestanding raised timber access platform adjacent to the rear elevation of the existing dwellinghouse. The platform will measure approximately 6.4 metres in length and 1.008 metres in width, with a finished floor level approximately 1.14 metres above the existing garden level to align with the threshold level of the existing rear doors. The proposal includes associated steps providing access between the platform and the rear garden, together with handrails and balustrading around the platform and stairway for safety purposes. The structure will be freestanding and positioned immediately adjacent to the rear of the dwellinghouse. No new vehicular or pedestrian access is proposed.
