If within a period of 5 years from the completion of the development hereby permitted, any tree, shrub or hedge is removed, uprooted or destroyed or dies, or becomes, in the opinion of the Council, seriously damaged, another tree, shrub or hedge of the same species and size as that originally planted shall be planted within the next available planting season at the same place, unless the Council gives written consent to any variation” Condition 15 reads: The vehicular access points, including visibility splays and any forward sight distance, shall be provided in accordance with drawing number 02B prior to the occupation of the development hereby permitted. The area within the visibility splays and any forward sight line shall be cleared to provide a level surface no higher than 250mm above the level of the adjoining carriageway and such splays shall be retained and kept clear thereafter.

    Discharge of conditions 11 and 12 of LA08/2024/0644/F which read: The construction of the development approved herein shall not commence until a final hard and soft landscape and open space management and maintenance plan has been submitted to and approved by the Council in writing. The plan shall set out the period of the plan, long term objectives, management responsibilities, performance measures and maintenance schedules of all areas of landscaping and open space as shown on Drawing Nos. 02D and 40B. It shall also set out details of the arrangements that will be put in place for the future management and maintenance in perpetuity of these areas, including details of the legal agreement, between the prospective residents and Management Company, which are to be put in place as per policy OS 2 of PPS 8. The landscape and open space management plan shall be carried out as approved unless prior written consent is granted by the Council to any variation. There shall be no demolition of buildings or vegetation clearance, during the bird breeding season (1 March to 31 August inclusive), unless a competent ecologist has undertaken a detailed check for active bird nests immediately before clearance and written confirmation that no nests are present, no birds will be harmed and/or there are appropriate measures in place to protect nesting birds and evidence of this has been provided to and agreed in writing with the Council prior to their removal.
